Welcome to Unlocked Fitness Studio. These Terms and Conditions ("Terms") govern your use of our facilities, services, classes, online platforms, and any related products. By becoming a member, booking a session, or using our website, you agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use our services.

Definitions
"Unlocked", "we", "us", "our" refers to Unlocked Fitness Studio, located at Devonbosch, Bottelary Road, Stellenbosch, 7605, South Africa.
"Member", "you", "your" refers to any person who has signed up for a membership, booked a session, attended a class, or used any of our services.
"Services" includes group training sessions, personal training, nutrition coaching, online programmes, events, and any other products or services provided by Unlocked.

Membership
Eligibility
You must be at least 18 years old to sign up for a membership. Members under 18 require written consent from a parent or legal guardian.
Sign-Up
Membership begins on the date of your first paid debit order or upfront payment. By signing up, you confirm that all information provided is accurate and complete.
Membership Types
We offer a range of membership options including 2x per week, 3x per week, and unlimited access. Each option includes specific benefits as outlined at the time of sign-up.

Payments & Billing
Monthly Debit Orders
Memberships are billed via monthly debit order on or around the 1st of each month. You authorise Unlocked Fitness Studio to debit the bank account or card you have nominated.
Failed Payments
If a payment fails for any reason, you will be notified and given 7 days to settle the outstanding amount. Continued failure to pay may result in suspension or termination of your membership.
Price Changes
Membership fees are reviewed annually. We will provide at least 30 days' written notice of any price increase.
Other Payments
Event fees, merchandise purchases, and once-off services are payable upfront via the payment methods made available at the time of purchase, including secure online payment via Payfast.

Cancellation & Refunds
Membership Cancellation
You may cancel your membership at any time by giving us at least one (1) calendar month's written notice via email to unlockedfitnessstudio@gmail.com. Cancellations received mid-month will take effect at the end of the following month.
Pause / Freeze
Members may pause their membership for up to one month per calendar year due to medical reasons, travel, or other valid circumstances, subject to our approval and reasonable notice.
Refunds
Membership fees are non-refundable once a debit order has been processed. Event tickets, including birthday celebrations and special events, are non-refundable and non-transferable except where required by law.
Class Bookings
Booked sessions can be cancelled up to 4 hours before the session start time without penalty. Late cancellations or no-shows may forfeit the session credit.

Health, Safety & Liability
Medical Clearance
You confirm that you are in good physical health and able to participate in physical exercise. If you have any medical condition, injury, pregnancy, or concern, you must consult a doctor before joining and disclose this to your coach.
Assumption of Risk
Participation in any form of exercise carries inherent risk of injury. By using our services, you voluntarily accept all risks associated with physical training.
Limitation of Liability
To the fullest extent permitted by law, Unlocked Fitness Studio, its owners, coaches, employees, and contractors shall not be liable for any injury, illness, loss, damage, or theft of personal belongings sustained while on the premises or during any service, save where such loss is caused by our gross negligence or wilful misconduct.
Personal Belongings
You are responsible for your own belongings. We recommend you do not bring valuables to the studio.

Conduct & Studio Etiquette
We pride ourselves on creating a safe, inclusive, and welcoming community. By being part of Unlocked, you agree to:
- Treat coaches, staff, and fellow members with respect at all times.
- Arrive on time, ready to train, and dressed appropriately.
- Follow all instructions from coaches and observe safety guidelines.
- Return equipment to its proper place after use.
- Refrain from any behaviour that is abusive, discriminatory, threatening, or disruptive.
We reserve the right to suspend or terminate the membership of any person who, in our reasonable opinion, breaches these standards.

Events & Special Occasions
From time to time we host events, celebrations, or special offerings (including but not limited to our birthday celebrations, run club events, and partner experiences).
- Event tickets are sold on a first-come, first-served basis and may be subject to capacity limits.
- All event payments are non-refundable unless the event is cancelled by us.
- By attending, you consent to photos and video being taken which may be used for marketing purposes.
- You may withdraw consent for image use at any time by contacting us in writing.

Online Services & Digital Content
Where you access online programmes, workouts, nutrition plans, or coaching content provided by Unlocked, you agree that:
- The content is for your personal, non-commercial use only.
- You may not copy, distribute, share, or sell any of our digital content.
- All intellectual property in our programmes, content, branding, and materials remains the property of Unlocked Fitness Studio.
- Login details must not be shared with any third party.

Privacy & Data Protection
We take your privacy seriously and process personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA").
Information We Collect
Name, contact details, date of birth, payment information, health and fitness information you voluntarily provide, and attendance/training data.
How We Use It
To manage your membership, communicate with you about classes and events, process payments, personalise your training experience, and improve our services.
Sharing
We do not sell your information. We share it only with trusted service providers (such as Payfast for payments, Itensity for class bookings, and Vitality for rewards) to the extent necessary to provide our services.
Your Rights
You may request access to, correction of, or deletion of your personal information at any time by contacting us at unlockedfitnessstudio@gmail.com.

Website Use
The Unlocked Fitness Studio website is provided "as is". We make reasonable efforts to keep the site accurate and accessible but do not guarantee uninterrupted availability or freedom from errors.
You agree not to use the website in any unlawful manner, attempt to gain unauthorised access to any systems, or interfere with the operation of the site in any way.
All content on this website — including text, images, logos, and design — is the property of Unlocked Fitness Studio and may not be reproduced without written permission.

Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on our website with the new "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

Governing Law & Disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms shall be resolved through good-faith discussion in the first instance. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts of the Western Cape.
